iThese Game Rules for Build Mode (the "Rules") form an integral part of the Terms of Service that govern your use of the Build Mode feature in the game Strinova (the "Game") provided by iDreamSky and its affiliates ( "we" "us", or "our").
PLEASE ENSURE THAT YOU HAVE CAREFULLY READ AND FULLY UNDERSTOOD THESE RULES. CERTAIN CLAUSES THAT MAY SIGNIFICANTLY AFFECT YOUR RIGHTS AND OBLIGATIONS ARE HIGHLIGHTED IN BOLD FOR YOUR ATTENTION.
IF YOU DO NOT AGREE TO THESE RULES, DO NOT USE THE Build MODE FEATURE. BY ACCESSING OR USING Build MODE, YOU ARE DEEMED TO HAVE READ, UNDERSTOOD, AND AGREED TO BE BOUND BY THESE RULES.
IF YOU ARE A MINOR UNDER THE AGE OF 18 (OR UNDER THE MINIMUM AGE REQUIRED FOR THE PROCESSING OF PERSONAL INFORMATION IN YOUR JURISDICTION), YOU MUST OBTAIN CONSENT FROM A PARENT OR LEGAL GUARDIAN BEFORE USING BUILD MODE AND ACCEPTING THESE RULES.
1.1 The maps, files, images, scripts and other data you create, upload, publish, submit or transmit in or through Build Mode shall be considered User Content as defined under the Terms of Service.
1.2 You are solely responsible for your actions or inactions when using Build Mode in the Game, including but not limited to the creation, uploading, publication, submission or transmission of any User Content.
1.3 In the event of a violation of these Rules, we reserve the right, to the fullest extent permitted by applicable laws and without prior notice, to take one or more of the following actions:
(i) restrict, temporarily suspend, or permanently terminate your access to the Game, Game account and any related services;
(ii) restrict, temporarily suspend, or permanently terminate your access to any game features or gameplay;
(iii) restrict, temporarily suspend, or permanently prohibit your specific device(s) from accessing the Game;
(iv) remove or delete any User Content you have submitted; and/or
(v) deduct or revoke any rewards granted or to be granted to your Game account.
1.4 You agree to indemnify, defend, and hold harmless iDreamSky, its affiliates, and their respective officers, directors, employees, agents, licensors, representatives, and third party providers from and against any and all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, arising out of or related to your violation of these Rules.
2. PROHIBITIONS AND RESTRICTIONS
While using Build Mode, you agree NOT to engage in any of the following:
2.1 Illgal Activities
• Violate any applicable laws, regulations, or the Terms of Service.
• Discuss, promote, advertise, or provide links to illegal or restricted content, including drugs, weapons, terrorism, fraud, theft, gambling, alcohol, tobacco, or other controlled substances.
2.2 Abuse and Harassment
• Bully, insult, defame, harass, threaten, or attack others.
• Use hate speech, obscene, vulgar, pornographic, blasphemous, paedophilic, or offensive language, including masked or implied profanity.
• Make derogatory or discriminatory remarks based on race, nationality, religion, gender, sexuality, or other protected characteristics.
2.3 Cheating and Exploits
• Promote, support, or engage in hacking, cheating, or the use of unauthorized tools or exploits.
• Encourage unfair gameplay or manipulation of game systems.
2.4 Spam and Misinformation
• Post repetitive, irrelevant, or nonsensical content.
• Engage in deceptive behavior, phishing, impersonation, or misleading advertising (e.g., clickbait).
• Imply or claim any official relationship, endorsement, or partnership with the Game, iDreamSky or iDreamSky's affiliates without explicit authorization.
2.5 Unauthorized Transactions
• Charge or induce others to make payments, click links, or download content.
• Promote or conduct commercial activities without authorization.
2.6 Intellectual Property and Privacy Violations
• Infringe on others' copyrights, trademarks, patents or other legal rights.
• Use third-party content or likeness without permission.
• Share others' personal information without consent.
3.1 While using Build Mode, you are encouraged to create original, creative and strategic maps that align with the Game's third-person anime-style shooter theme. Designs that thoughtfully incorporate terrain features, cover points, ambush zones, and tactical gameplay mechanics are especially supported. However, the following actions are strictly prohibited in map creation:
• Designing traps, impassable obstacles, or any elements that intentionally interfere with or obstruct normal gameplay.
• Incorporating excessive overlapping objects, repetitive special effects, or other elements likely to cause lag, crashes, or performance issues.
• Including content that undermines gameplay quality or disrupts the user experience of others.
3.2 When promoting or sharing any User Content created via Build Mode, you must comply with all applicable laws and these Rules. The following activities are prohibited during such promotional efforts:
• Making false or misleading claims, including implying any official partnership, sponsorship, or endorsement by us without authorization.
• Engaging in any activity that may tarnish or damage the reputation of the Game.
• Taking actions that harm or negatively affect iDreamSky or its affiliates in any way.
4. INTELLECTUAL PROPERTY RIGHTS
4.1 All intellectual property rights related to the Game, including but not limited to its name, characters, artwork, storylines, visual effects, audio, code, and other related content, are the exclusive property of iDreamSky. You may not copy, modify, distribute, display, use for commercial purposes, or otherwise infringe upon these rights without our prior written consent.
4.2 Without prejudice to Section 4.1, all User Content that you create or submit via, through, or within Build Mode, including map layouts, decorative assets, scene designs, and other elements shall remain your intellectual property. However, you hereby grant us an irrevocable, exclusive, perpetual and royalty-free license, worldwide, to use such User Content in any manner, including but not limited to reproducing, modifying, adapting, publishing, publicly displaying, communicating via information networks, redeveloping, migrating to other platforms or products, distributing, or promoting it for sale or marketing through any media or medium, as well as any other form of commercial exploitation. You further agree that we have the right to determine whether to attribute authorship and may assign or sublicense any or all of the foregoing rights to third parties. You also agree to cooperate with us in taking any actions necessary to establish, protect, or enforce such rights.
4.3 You may only display or use the User Content within the Game as permitted by us. Without our prior written consent, you shall not use, license, distribute, or othewise make available the User Content in any other products, channels or platforms, nor shall you create derivative works based on it or use it for any other unauthorized purposes.
5.1 To the maximum extent permitted by applicable law, Build Mode and any related services are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. Where permitted by law, we expressly disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, timeliness, completeness, and non-infringement. We do not warrant that Build Mode will operate uninterrupted or error-free, that any defects will be corrected, or that it will be free from viruses or other harmful components. We make no representations or warranties regarding the accuracy, reliability, or suitability of any materials or results arising from the use of Build Mode.
5.2 While we reserve the right, in our sole discretion, to review User Content submitted through Build Mode, we do not guarantee its legality, safety, accuracy, appropriateness or usability. You acknowledge and accept all risks associated with accessing, downloading, installing, or using any User Content made available via Build Mode, and you assume full responsibility for any consequences arising therefrom.
6.1 We may update these Rules at our time of need. You must accept the updated Rules to continue using Build Mode. Your continued access to or use of Build Mode following any updates to these Rules, with or without prior notice from us, constitutes your acceptance of the revised Rules.
6.2 These Rules are supplemental to and form an integral part of the Terms of Service. For matters not covered herein, the relevant provisions of the Terms of Service shall apply. Capitalized terms used and not otherwise defined herein shall have the meanings ascribed to such terms in the Terms of Service. In the event of any inconsistency between these Rules and the Terms of Service, the provisions of these Rules shall prevail with respect to the use of Build Mode.
